Justice Bell

With the retirement of Justice Michael Kirby it’s my understanding that Justice Bell of the Family Court (Brisbane registry) is now the most senior judge in Australia.  He is a “lifer” and I’m not aware that he plans to retire.

Kennon v Spry - update

Dr Spry is very unhappy with some members of the High Court.  Letters are circulating written by the unsuccessful appellant to Justices French and Hayne, the publication of which I will not perpetuate.  Colourful!

Family Trusts

The High Court of Australia has delivered judgement in Kennon v Spry [2008] HCA 56 .  I am told it has a lot to say about the accessibility of the family law property power to trust assets.

I haven’t read it yet, but it is a must read for all family lawyers.

Bushfires

I have twice evacuated to avoid Victorian bushfires.  I have seen them travel as a rolling explosion - terrifying.

The partners and staff of Barry & Nilsson have passed on their donation to the bushfire appeal  of $10,522.

New defacto legislation will cause increase in case load in the Family Court

 The new federal de facto legislation commences operation on the 1st March.  De facto property disputes and de facto spouse maintenance issues (including same sex) will then be the domain of the federal Family Law Courts.
There will be a large case load, including some pent up demand from those waiting in the belief the new regime will be more favourable.

The Government was asked for 6 new judicial officers to meet this predicted demand.  One is to be appointed.

Perhaps the demand could be met by some underemployed judges working more efficiently.
