Computer files should be disclosed
Tuesday, January 13th, 2009A recent FMC decision underlines the obligation to disclose relevant computerised files in court proceedings (appeal decision). However, safeguards need to be put in place to protect privileged or personal information stored on computers. A court should not make an undefined order giving the other party access to all information stored on the computer.
